R. Shawn Oliphant

R. Shawn Oliphant is a founding partner of the firm Fahrendorf, Viloria, Oliphant & Oster L.L.P., and is the head of the firm's Civil Litigation and Financial Institution groups.   

Mr. Oliphant has successfully represented community financial institutions through complex foreclosure and collection cases, often securing multi-million dollar deficiency judgments following foreclosure.  Examples of claims Mr. Oliphant has represented financial institutions on include actions for breach of loan agreements, commercial collections, foreclosures, creditors’ rights in bankruptcy, loan participation disputes, construction loan disputes, Uniform Commercial Code disputes, lenders liability claims, breach of contract and fiduciary duty claims, mechanic’s liens and priority issues and loan workouts.  Mr. Oliphant has also successfully represented community financial institutions in prosecuting claims against title insurance and escrow companies who have failed to perform their duties to the financial institution.

Mr. Oliphant also represents developers, contractors, engineers and architects in all aspects of construction law from contract negotiation to mechanic lien foreclosures. Mr. Oliphant also regularly represents design professionals in complex multi-million dollar construction cases and serves as panel counsel  for a large number of insurance companies for construction defect and professional negligence claims.

Mr. Oliphant's leadership in development and construction is reflected in the firm's clients which make up the who's who in Northern Nevada's development and design professional industry. Mr. Oliphant has served as a key note speaker and lecturer on a variety of construction law topics for the Builders Association of Northern Nevada, the American Institute of Architects, and the Nevada Association of Land Surveyors.
 
Mr. Oliphant is a native northern Nevadan and received his bachelor degree in Business Administration with distinction from the University of Nevada. Mr. Oliphant attended law school at the University of Arizona where he graduated Summa Cum Laude and Order of the Coif, and served on the Law Review Editorial Board. Mr. Oliphant's law review Note encouraging the legalization of gaming advertisements was published in the University of Arizona Law review and has been cited and followed in United States Supreme Court cases and law review articles.
 
Mr. Oliphant is admitted to practice in the Supreme Court of the State of Nevada, the U.S. District Court, and the United States Court of Appeals for the Ninth Circuit. Mr. Oliphant is a member of the American Bar Association, ABA Construction Industry Forum Member, Builders Association of Northern Nevada Member and Faculty Guest Lecturer, National Registry of Who’s Who in America, Order of the Coif, Goldenkey National Honors Society, Phi Beta Kappa National Business Honors Society and the Ducks Unlimited Committee Member for the Sparks Nevada Chapter. Mr. Oliphant has been awarded the Western Interstate Commission of Higher Education Award for Nevada, Army
