Wrongful Death Damages Explained

Who Can Claim Damages

Under Nevada’s wrongful death statutes, there are two classes of people who can seek financial damages against those responsible, including: (1) the victim’s intestate heirs and (2) the personal representatives of the victim’s estate. Intestate heirs are the people entitled to inherit when a person dies without a will. There is a priority given to the wife and children of the deceased. Parents of the deceased stand to inherit if there is no wife or children. So if a person is entitled to inherit intestate, they are entitled to seek wrongful death damages.

Heirs Seeking Damages

A jury can award each heir damages for the following damages incurred from a wrongful death:

  1. Funeral expenses;
  2. The person’s grief or sorrow;
  3. Loss of probable support from the deceased;
  4. Loss of companionship;
  5. Loss of society;
  6. Loss of “comfort and consortium”;
  7. Pain, suffering, or disfigurement of the deceased.

Also, under NRS 41.100, heirs are entitled to pursue a separate “survival action”, which includes all the losses and damages that were incurred before the death of the victim. These include medical bills, lost wages, pain and suffering, loss of consortium, and extraordinary “punitive” and “exemplary” damages.
