Viloria, Oliphant, Oster & Aman L.L.P. (VOOA) is proud to announce a landmark legal victory that will bring sweeping changes to Waste Management’s commercial collection practices across Northern Nevada.

After six years of hard-fought litigation, a major settlement has been reached that directly impacts exclusive franchise agreements with the cities of Reno, Sparks, Carson City, and Washoe County. This groundbreaking case was filed on behalf of a commercial property owner who experienced unpredictable waste pickup schedules and excessive overage fees passed on to tenants—sometimes totaling tens of thousands of dollars annually.

Property managers reported pickup times ranging from 4 a.m. to 10 p.m., making it nearly impossible to manage waste efficiently and avoid surprise penalties. The lawsuit alleged that these erratic practices created an unstable system, violating principles of fairness and transparency.

A pivotal moment in the case came in October 2024, when the Reno City Council voted unanimously to terminate Waste Management’s exclusive franchise agreement, signaling strong public support for systemic change.

Thanks to the recent settlement secured by our firm, Northern Nevada commercial clients can expect the following reforms to take effect within 90 days of court approval:

  • A standardized 3-hour pickup window
  • Advance pickup notifications via email, app, and mail
  • A 7-day grace period following the first overage notice
  • A two-warning system before any further penalties are assessed

These improvements will offer much-needed predictability and relief to property managers and commercial tenants across the region.

At Viloria, Oliphant, Oster & Aman L.L.P., we are honored to have played a role in holding one of the largest waste collection providers accountable and delivering meaningful, lasting change for our community. We remain committed to fighting for fairness and transparency—no matter how long the battle takes.
